EdenMoney® is a trading name of Eden Charge Limited, a company incorporated under the laws of the Isle of Man with register number 133351C, hereinafter referred to as “the Company”, or “Eden Charge”

Scope of these Terms and Conditions

These Terms and Conditions set out the nature and extent of your contractual relationship with the Company and the obligations which you agree to undertake. They are designed to be read in conjunction with the Company’s Privacy Policy, and govern the opening, use and cancellation of your EdenMoney® Account as well as other related payment services where applicable.

Use of some additional services may require the acceptance of specific additional terms and conditions, which the Company may notify you if and when required. It is advisable to print or download and keep a copy of these Terms and Conditions for future reference, however the most current version of this document will be available for inspection on the Company’s Website, which will always take precedence in the case of a dispute.

Your EdenMoney® Account

Electronic Money

Your EdenMoney® Account is an electronic money account that enables you to send and receive electronic payments.

Currency

Your EdenMoney® Account allows you to maintain accounts in multiple currencies of your choice, as selected by you from the currencies the EdenMoney® shall make available from time to time. When you open an account with the Company you must designate a home currency and the value of your overall account will be determined in your home currency, which will remain the primary currency of your EdenMoney® Account for the duration of your agreement with the Company.

Expiry

The electronic money held on your EdenMoney® Account does not expire but it will not earn any interest.

Redemption

You have the right to redeem funds from your EdenMoney® Account at any time. However, you may be required to confirm your identity beforehand. There is no minimum redemption amount but the funds on your EdenMoney® Account must be sufficient to cover any applicable redemption fee. You may choose the method of redemption when submitting your request.

Risk

Electronic money accounts are not bank accounts. By accepting these Terms and Conditions you acknowledge that your funds may be at risk in the event of the insolvency of the Company. The European Electronic Money Directive 2009/110/EC and Isle of Man national legislation require safeguards and minimum capitalisation designed to ensure the safety and liquidity of funds deposited in electronic money accounts. You may find information on how the Company safeguards its customer funds on its Website.

Ownership and Assignment

The electronic money stored in an EdenMoney® Account belongs to the person or legal entity registered as the EdenMoney® Account holder. No person or entity other than the EdenMoney® Account holder has any rights in relation to the funds held in an EdenMoney® Account, except in cases of succession. You may not assign or transfer your EdenMoney® Account to a third party or otherwise grant any third party a legal or equitable interest over it, or share your login details with another party.

Limits

Your EdenMoney® Account may be subject to upload, transfer and redemption limits, depending on your country of residence, the verification status of your EdenMoney® Account and other factors that may be used by us to determine such limits from time to time at our sole discretion.

Opening Your EdenMoney® Account

Acknowledgement – Privacy Policy and Terms and Conditions

In order to use our payment services you must first open an EdenMoney®  Account by registering your personal information on our Website. In doing so you will be asked to acknowledge and accept these Terms and Conditions as well as our Privacy Policy. You must have the legal capacity to accept the same.

Warranty

You warrant that all information you provide to us at any time shall be accurate and truthful.

You additionally warrant that you are the sole beneficial owner of all Payment Methods that you register with us for the purpose of uploading funds or redemption to a third-party account of any kind. The violation of this requirement may result in closure of your account and be treated as fraudulent use of our services.

Local Jurisdiction

You may only open an EdenMoney® Account if it is legal to do so in your country of residence. By opening an EdenMoney® Account you represent and warrant that in doing so you do not violate any laws or regulations applicable to you. A breach of this restriction may incur legal action.

Age of Consent

If you are an individual, you must be 18 years or older to use the services of the Company and by opening an EdenMoney® Account you declare that you conform to this requirement. The Company may from time apply different age limits according to the local laws in your jurisdiction. You will be required to provide evidence of your age.

Sole Account

An individual may only open one EdenMoney® Account.

Cancellation

Within 14 days of the date of opening your EdenMoney® Account, you may cancel your EdenMoney® Account at no cost by contacting Customer Service. Uploaded funds will be returned to you; however, you will be required to provide identification documents before being eligible to redeem your funds. Transactions and fees for transactions initiated prior to cancellation of your account are non-evocable

Maintaining Your EdenMoney® Account

Keeping your Personal Information up to Date

You must ensure that the information supplied to us and associated with your EdenMoney® Account continues to be accurate and current.  The Company bears no liability for any loss arising out of your failure to do so. From time to time we may ask you to update your Personal Information and may request evidence of any changes.

Official Communication Regarding your EdenMoney® Account

The Company may communicate with you by e-mail or in other ways described in section 18 regarding your EdenMoney® Account. You are responsible for ensuring the proper functioning of your email account or other designated methods of communication. The Company bears no liability or any losses arising from failure of your designated communication methods.

Statement of Account

Through the EdenMoney® Account interface you may view information about fund uploads, transfers received, transfers sent and redemptions together with the date of receipt or transmission (the debit value date), fees charged and, where applicable, any exchange rate used. Transactions are identified by a unique transaction ID which is displayed in the transaction history. The Company is not able to alter or amend information shown in your online transaction statement. The transaction ID may be referenced when communicating with us about a particular transaction. You should check your EdenMoney® Account balance and transaction history regularly and report any irregularities at once by contacting Customer Service.

We will send you an e-mail notification each month reminding you to log into your EdenMoney® Account to view and check your statement.

Errors and Irregularities

You must notify the Company immediately if you become aware of an unauthorised or incorrect transaction and in any event no later than thirteen (13) months after the debit date of the transaction. Subject to the provisions of section 8 below and without prejudice to the provisions of section 9.5(A), you may make a claim for a refund of an unauthorised or incorrectly executed payment transaction on your EdenMoney® Account, which will be given due consideration by the Company in the context of the circumstances surrounding the event.

Keeping Your EdenMoney® Account Safe

Password Security

Your password is valuable. The Company will never ask for your password either by email or telephone, and it is your responsibility to take all reasonable steps to keep your EdenMoney® Account password secure at all times. You should never disclose it to a third party under any circumstances.

The Company recommends that you do not choose a password that is easily guessed from information to which a third party might have access or choose a password that has a meaning.
In order to maintain the security of your EdenMoney® Account it is advisable to change your password on a regular basis, at least every six months.

You must never allow anyone to access your EdenMoney® Account or watch you accessing your EdenMoney® Account. It is important to comply with the security procedures notified to you from time to time.

You must always ensure that your login details are not stored by the browser or cached or otherwise recorded, especially if you are using a public or a shared computer to access your EdenMoney® Account.

Security Breaches

You must notify Customer Services without delay If you have any indication or suspicion that the security of your EdenMoney® Account, has been breached in any way. Undue delay may result in you being liable for any losses, especially if your failure to notify the Company is deemed to be intentional or grossly negligent.

If we think your EdenMoney® Account is at risk of fraud or a security threat, we will use the fastest and most secure way of contacting you using the details you have provided to tell you what you need to do to help deal with that risk.

Suspension

If the Company has reasonable grounds to think that the security of your EdenMoney® Account may have been compromised, or if the Company has reason to think that it may have been used in an unauthorised or fraudulent way, then the Company may at its sole discretion suspend your EdenMoney® Account or otherwise restrict its functionality. The Company will notify you of any suspension or restriction immediately after the suspension or restriction has taken place, unless notifying you would be unlawful or compromise security interests. The suspension or the restriction may be lifted as soon as practicable after the reasons for its suspension or restriction have been addressed.

Security of Email

Precautions must be taken by you to ensure the security of the e-mail account(s) associated with your EdenMoney®  Account, and that you have sole access to it, as your e-mail address may be used to reset passwords or to otherwise communicate with you about the security of your EdenMoney® Account. In the event that your e-mail address is compromised, you must report it at once to Customer Services.

Cancelling Your EdenMoney® Account

Notification

You may cancel your EdenMoney® Account at any time by notifying Customer Services. You may send an email to support@edenmoney.com after which you may be asked to explain your reasons for wishing to cancel, to help us to improve our services. You are not obliged to give a reason but we hate to lose a customer and your input is valued.

AML Checks

Before authorising the redemption of any balances remaining on your account, the Company reserves the right to carry out appropriate money laundering, terrorism financing, fraud or other illegal activity checks in connection with the conduct of your EdenMoney®  Account. Redemptions will not be unduly delayed by this process except in exceptional cases.

Redemptions post Cancellation

Subject to satisfactory checks and if your EdenMoney®  Account holds a balance at the time of its cancellation, you will be asked to withdraw your funds within a reasonable period of time, during which time your EdenMoney®  Account will be restricted and  accessible solely for the purposes of redeeming the remaining balance.

Transaction History

After the cancellation of your account, your transactions history will be available on request from Customer Services.  This information will be available for a period of six years from the date of closure of your EdenMoney® Account.

Uploading Funds, Chargebacks and Refunds

Payment Methods

You may use a variety of different third-party payment methods to upload funds to your EdenMoney® Account, which may include credit/debit cards and bank transfers. Availability will vary according to your country of residence. When you upload funds to your account you will need to log into your EdenMoney® Account and choose a payment method, then follow the instructions.
We do not guarantee the availability of any specific payment method and may make changes to or discontinue the acceptance of any particular upload method at any time. The Company shall not be responsible for crediting funds until such time as the uploaded funds have been cleared by its own payment institution.

Authorisation

Additional information including passwords or security questions may be required by your payment method provider in order to authorise your upload transaction.

Chargebacks

Some Payment Methods, including credit and debit card issuers, have provision for an account holder to reclaim funds (a “Chargeback”). You agree that you will not attempt to Chargeback funds other than in the event of unauthorised use of the Payment Method or a breach by us of these Terms and Conditions. It is not permitted to Chargeback any upload transaction or allow Chargeback of any upload transaction for any reason unless the Company is held to be directly accountable for a contested amount. This means that disputes with merchants to which you have transferred funds from your EdenMoney® Account are not valid reasons to initiate a Chargeback. The Company in this respect reserves the right to levy fees and expenses incurred in connection with such Chargeback. The Company may also impose you a Chargeback fee of 100 EUR per instance, which will be debited from your EdenMoney® Account.

Refunds

If you receive a refund for purchases made with your EdenMoney® wallet, the refund amount will be paid back to your EdenMoney® wallet.

Any refunds for funds deposited by Debit or Credit card will be returned back to the original card. You are not allowed to receive refunds in cash for transactions made using your Debit or Credit card. Refunds can take up to 30 days to procress.

Negative Balances

You are not permitted to have a negative balance in your account. If a negative balance transpires for whatever reason, you will be required to repay such negative balance by uploading sufficient funds immediately into your EdenMoney® Account. Failure to do so is a breach of these Terms and conditions. The Company reserves the right, at any time, to send you reminders or to take other debt collection measures including but not limited to mandating a debt collection agency or lawyers or to pursue the claim in court. Furthermore, the Company reserves the right to charge you reasonable expenses in connection with any recovery activity.

Value Date

The Company will endeavour to reflect your uploaded funds in your EdenMoney® Account balance directly the funds have appeared as cleared funds in its account. Certain types of payment method, such as those by credit or debit card, will be credited to your EdenMoney® Account immediately. Certain other types of payment method may take longer and will appear as uncleared funds in your EdenMoney® Account. The value date is the date on which the cleared funds are credited to your EdenMoney® Account.

Beneficial Owner

You must not make an upload through a Payment Method if you are not the beneficial owner of that Payment Method. A violation of this requirement is viewed very seriously and may be reported to law enforcement authorities as a fraudulent act, and your EdenMoney® Account is liable to be cancelled without further notice. The Company reserves the right to apply a penalty of EUR 100 for each incidence of this breach of the Terms and Conditions without prejudice to further claims.

Upload Limits

According to your account status, transaction history and payment method the Company applies limits to the amounts that you will be permitted to upload to your EdenMoney® Account.

Upload limits are in place to prevent Money Laundering and Fraud, as well as to protect individuals. You can view these limits at any time in the relevant section of your EdenMoney® Account profile.

Upload Transactions Fees

Uploads may be subject to transaction fees and may attract foreign exchange charges where applicable.

Cash Transactions

The Company does not accept cash transactions. If the Company identifies a cash transaction related to your EdenMoney® Account then the account will be cancelled.

Outgoing Transfers

Beneficiaries

You may transfer funds from any of your currency accounts to:

  • An Internet merchant integrated with the EdenMoney® Account system
  • Another EdenMoney® Account holder

Making a Transfer

To make a transfer you are required to authorise the payment with your login details and password, either on the merchant site or from within your EdenMoney® Account. If your EdenMoney® Account is protected by additional security measures such as password tokens or SMS confirmations, you need to follow the instructions provided to you with such additional security measures.

Recipients of a transfer from an EdenMoney® Account must have a valid identifier. For most of services that means of identification will be a valid e-mail address, in particular to another EdenMoney® Account holder, but other means of identification may be required in accordance with AML procedures.

Transfer Limits

Transfer limits apply due to security and legal requirements. These limits are set dynamically depending on your account status. You can view these limits at any time in your EdenMoney® Account profile.

Transfer Fees

Transfers are subject to fees including currency conversion fees (if applicable) depending on the type of payment you make and the type of EdenMoney® Account you hold. See the current tariffs on the Company’s website for details.

Value Date

Transfers to another EdenMoney® Account or to an online merchant integrated with the EdenMoney® Account Payment System are processed in real time, and the value date will be the same as the date of the Transfer.

Receiving Transfers

Payers

You may receive a transfer from the following payers:

  • An Internet merchant integrated with the EdenMoney® Account system
  • Another EdenMoney® Account holder

Notification

If you receive funds into your EdenMoney® Account, the Company will send you a notification email and display the payment as a received transfer in your EdenMoney® Account, together with the value date, the fees charged and, where applicable, any exchange rate used.

Reversals

Receipt of funds to your EdenMoney® Account does not guarantee that transactions may not be reversed. The Company reserves the right to reverse a payment if the payer or the payer’s bank or payment method has charged back or otherwise reversed funds used to make an upload that are subsequently used to send a transfer to you.

Fees

Transfer receipts may be subject to fees and currency exchange fees, depending on the type of transfer you receive and the type of EdenMoney® Account you hold. Current tariffs are available on the Company website.

Prohibited transactions

Prohibited Categories

Payments for some categories of goods or service are expressly forbidden. Sending or receiving transfers that fall into the following categories is not permitted:

Prescription drugs, drugs and drug paraphernalia, weapons (including without limitation, knives, guns, firearms or ammunition), extreme pornography including child pornography and bestiality, material which may incite violence, hatred or racism, government IDs and licences including replicas and novelty items and any counterfeit products, illegal lotteries, unregistered charity services, goods or services that infringe the intellectual property rights of a third party.

This list is not exhaustive, and the Company reserves the right, at its sole discretion, to add categories either to these Terms and Conditions or an acceptable use policy published on the Website.

Prohibited Countries

You may not use the services of the Company if you are a resident in certain countries.

Nationals of any country listed on the Treasury Department’s Office of Foreign Asset Control (OFAC) are not permitted to open an EdenMoney® Account. The current list, which may be updated from time to time includes: Balkans, Belarus, Burma, Cote D”Ivoire (Ivory Coast), Cuba, Democratic Republic of Congo, Iran, Iraq, Liberia, North Korea, Sudan, Syria, and Zimbabwe.

Illegal and Fraudulent Activity

Your EdenMoney® Account may not be used for any illegal purposes including fraud and money laundering. Suspicious activity will be reported relevant law enforcement agency.

Violation

Violation of the prohibitions contained in this section is likely to result in the reversal of transactions, cancellation or suspension of your EdenMoney® Account and the reporting of suspicious transactions to law enforcement; The Company also reserves the right to impose financial penalties.

Redemption

Method

You may initiate a redemption request for or part of the funds held in your EdenMoney® Account at any time. To do this you must log into your EdenMoney® Account and select a redemption method and enter the amount to be redeemed. Redemption methods are payment services provided by third party financial institutions such as banks. The Company does not guarantee the availability of any particular redemption method and may make changes to or discontinue a particular withdrawal method at any time as long as there is at least one withdrawal method available to you. The Company is expressly not responsible for the receipt of funds into any third-party payment provider. If the redemption is received by you through the medium of a payment service provider the Company bears no responsibility for the funds once received by your payment service provider.

Redemption Limits

Your EdenMoney® Account is subject to redemption limits. These limits are adjusted dynamically depending on the type of identification documentation we hold on you. You can view your redemption limits at any time in your EdenMoney® Account profile.

In the event that your redemption request exceeds the current limit, the Company may decline your request and first require additional identity verification documents prior to allowing the redemption to take place.

Fees

Redemptions may be subject to fees including currency conversion fees (if applicable), but only insofar as they cover the reasonable expenses incurred by the Company in processing the redemption.

Beneficial Owner of the Account

It is not permitted to redeem funds to a bank account or other Payment Method if you are not the named beneficial owner of the account (See 4.2). A violation of this requirement is viewed very seriously and may be reported to law enforcement authorities as a fraudulent act, and your EdenMoney® Account is liable to be cancelled without further notice. The Company reserves the right to apply a penalty of EUR 100 for each incidence of this breach of the Terms and Conditions without prejudice to further claims.

Accuracy of Payment Details

The company is not liable for redeemed funds that are sent to the wrong account where this is attributed to incorrect payment details being entered by you. You must ensure that the account number, sort code, IBAN and/or BIC/SWIFT are correct when entering the details on the EdenMoney® website.

Fees

Tariffs

The current tariffs may be viewed at any time in the “Fees” section of the Company’s Website. Additional fees may apply to EdenMoney® Accounts used for commercial purposes. The “Fees” section forms part of these Terms and Conditions. Fees are subject to change.

Foreign Exchange

Your transactions may be subject to currency conversions. Circumstances where this may arise are:

An Internal Transfer

Where you transfer funds from one of your currency accounts to another

Insufficient Funds

Where you have insufficient funds in the designated currency of a transaction but your overall EdenMoney® balance is sufficient to cover the transaction. In this case, the balance of the transaction will be debited from your designated base currency account and converted to the currency of the intended transfer.

Third-Party Currency Transfer

Where you make a transfer in one currency to third-party account denominated in a different currency

Exchange Rates

For every currency conversion, we will apply the average daily interbank market rate published by a third-party foreign currency data provider (OandA) plus 2.25{56431e5ddb33c67834c9f42243825cd0821845b0a2ed67088c230aafcb14e429}.

Calculation of Fees

The Company’s Fees are either expressed as a percentage of a transaction or as a fixed amount in the currency of the transferring account.

Deductions

You authorise the Company to deduct its fees from your EdenMoney® Account balance. Transaction fees will be charged when the transaction is executed. If your EdenMoney® Account balance in the currency of the transaction is insufficient to cover the fees, the Company may firstly have recourse to your base currency account, where foreign exchange rates apply according to 13.3. If there are still insufficient funds then the Company may refuse to execute the transaction. Reversal or chargeback fees will be deducted when incurred.

Your Data

Explicit Consent

You explicitly consent to us accessing, processing, and retaining any information you provide to us, for the purposes of providing payment services to you. This does not affect our respective rights and obligations under data protection legislation. You may withdraw this consent by closing your EdenMoney® Account. If you withdraw consent in this way, we will cease using your data for this purpose, but may continue to process your data for other purposes where we have other lawful grounds to do so, such as where we are legally required to keep records of transactions.

Additionally, by disclosing your personal information to the Company, including, but not limited to, by using the EdenMoney® website and or applications, contacting the Company by email, and speaking to the Company over the telephone, you consent to the collection, storage, and processing of your personal information as stated in the Company’s Privacy Policy.

Right to Object

You have the right to ask the Company not to process your Personal Data for marketing purposes. The Company will always tell you before collecting your data if the Company wishes to use it for such purposes.

You may exercise your right to prevent such processing by indicating your preferences on the forms are presented to you for the purposes of collecting information about you. You may also exercise this right at any time by contacting the Company

Our Privacy Policy

The processing of your data is governed by our Privacy Policy which can be found on our Website and should be read in conjunction with these Terms and Conditions. By accepting these Terms and Conditions, you agree to the terms of our Privacy Policy which is to be found on the Company’s website.

Liability

Unauthorised Payments

In the exceptional event of an unauthorised payment or a payment erroneously executed by the Company, the Company shall, as soon as practicable, refund the payment amount and associated fees. This shall not apply in cases of:

Security Negligence

circumstances where the unauthorised payment arises from your failure to keep the personalised security features of your EdenMoney® Account safe in accordance with section 6 of these Terms and Conditions, in which case you shall remain liable for the first 35 EUR (or equivalent in the currency of your EdenMoney® Account);

Failure to Report Security Breach

failure to notify the Company without undue delay of the loss or compromise of your password or other event that could reasonably be expected to have affected the security of your EdenMoney® Account;

Fraud

a transaction was unauthorised, but you have acted fraudulently or compromised the security of your EdenMoney® Account with intent or gross negligence, in which case you shall be solely liable for all losses; or

Failure to Notify

if you fail to dispute and bring the unauthorised or incorrectly executed transaction to our attention within 13 months from the date of the transaction.

Misdirected Payments

The Company shall take every reasonable measure to assist you with tracing and recovering incorrect or misdirected payments. The Company bears no liability for losses arising from misdirected or erroneous payments that are the result of your negligence.

Disruption of Service

The Company bears no liability for any disruption or impairment of our service or for disruptions or impairments of intermediary services on which we rely for the performance of our obligations hereunder, provided that such disruption or impairment is due to abnormal and unforeseeable circumstances beyond our reasonable control or the control of the intermediary affected.

We shall not be liable for any indirect or consequential losses including but not limited to loss of profit, loss of business and loss of reputation. We shall not be liable for any losses arising from our compliance with legal and regulatory requirements.

Death or Personal Injury

Nothing in these Terms and Conditions shall operate to exclude liability for death or personal injury due to negligence or for fraud or fraudulent misrepresentation or for any statutory liability that cannot be excluded or amended by agreement between the parties.

The Company’s Obligations

The obligation of the Company under these Terms and Conditions is limited to providing you with an electronic money account and related payment services and the Company makes no guarantee or endorsement of the quality, safety or legality of any goods or services provided by an EdenMoney® customer or intermediary.

Neither shall the Company be liable for the assessment or payment of any taxes, duties or other charges that arise from your use of the EdenMoney® Account or services provided under these Terms and Conditions.

Reimbursement

You agree to defend, reimburse or compensate the Company and hold it harmless from any claim, demand, expenses or costs (including legal fees, fines or penalties) that the Company incurs or suffers due to or arising out of your or your agents” breach of these Terms and Conditions, breach of any applicable law or regulation and/or use of the services. This provision shall survive termination of the relationship between you and the Company.

Cancellation and suspension

Notice

The Company reserves the right to terminate your EdenMoney® Account or any payment service associated with for any reason by giving you two months’ prior notice. You may terminate your EdenMoney® Account with the Company at any time.

Redemption on Cancellation

Together with a termination notice or at any time thereafter the Company may give you reasonable instructions on how to redeem funds on your account.

Cancellation with Notice

The Company may at any time suspend or terminate your EdenMoney® Account without notice if:

  • you breach any condition of these Terms of Use;
  • you violate or the Company has reason to believe that you are in violation of any law or regulation that is applicable to your use of the Company’s services; or
  • The Company have reason to believe that you are involved in fraudulent activity of any kind, money laundering, terrorism financing or other criminal activity.

Suspension

The Company may suspend your EdenMoney® Account at any time if:

  • it reasonably believes that your EdenMoney® Account has been compromised or for other security reasons; or
  • it reasonably suspects your EdenMoney® Account to have been used or is being used without your authorisation or fraudulently.

Changes to Terms and Conditions

Review

These Terms and Conditions and any associated terms and conditions that may apply are subject to regular review. Changes will be implemented with prior notice under the procedure set forth in this section.

Notice

The Company undertakes to give notice to you of any proposed change by sending an email to the primary email address associated with your EdenMoney® Account.

The proposed change shall come into effect two months after the date the change notice is deemed received under section 18.1, unless you have given us notice that you object to the proposed changes before the changes come into effect. Changes to exchange rates shall come into effect immediately without notice and you shall not have the right to object to such a change.

Objections

If you choose object to changes in the Terms and Conditions, they shall be deemed not to apply to you. However, any such objection shall constitute a notice by you to terminate and close your EdenMoney® Account. Your EdenMoney® Account will be cancelled in accordance with the provisions of section 7 above.

Communication

Email

The primary method used by the Company to communicate with you about your account is by email. You must at all times maintain at least one valid email address in your EdenMoney® Account profile. You should check for incoming messages regularly, and you should ensure that the Company’s emails are reaching you and not being treated as SPAM. Emails may contain links to further communication on our Website. Any communication or notice sent by email will be deemed received by you on the same day if it is received in your email inbox before 4.30 pm on a Business Day. If it is received in your email inbox after 4:30pm on a Business Day or at any other time, it will be deemed received on the next Business Day.

Malware and Viruses

The Company will never send you emails attaching executable files or with links to such file types. If you receive any email with this type of attachment, you should delete the message without clicking on the attachment. If you are unsure whether a communication is originating from us, please contact Customer Services.

Phishing

The Company will never send you an email asking for your security information or directing you to input your login details or personal information on any site other than the website. Always check that the site has a valid certificate issued to EdenMoney® before inputting personal information.

Official Emails from the Company will always be sent from the edenmoney.com domain and will always reference your name and account number. Any email purporting to be from the Company that originates from a different domain or which does not reference your account number and name should be deleted and reported to phishing@edenmoney.com.

Language

We will communicate with you in English and will always accept communications made to us in English. You can choose your preferred language from the list of supported languages in your EdenMoney® Account profile and we will send you automated email notifications and communications regarding changes to these Terms and Conditions in your chosen language. For non-standard communication, we reserve the right to communicate with you in English. Documents or communications in any other languages are for convenience only and shall not constitute an obligation on us to conduct any further communication in that language.

The Company may contact you via letter or telephone, where appropriate or via SMS. Any communication or notice sent by post will be deemed received within five days of posting. Any communication or notice sent by SMS will be deemed received the same day.

Complaints

Complaints Policy

We have a complaints policy which is available on request. You may write to complaints@edenmoney.com to request a copy of this document.

Any complaints about us or the services we provide should be addressed to us in the first instance by contacting Customer Services. You should clearly indicate that you are wishing to make a complaint to us in order to distinguish a complaint from a query. We send will send you a complaint acknowledgement by post or by email within 48 hours of receiving your complaint in accordance with our complaints procedure.

Complaints Resolution

We endeavour to provide you with an answer or possible resolution to your complaint within 15 days. Should this not be possible due to unforeseen circumstances or lack of information, we will contact you.

Miscellaneous

Assignment

The Company may assign this Agreement and its rights and obligations hereunder in whole, but not in part, to any corporation or other entity with or into which the Company may hereafter merge or consolidate or to which the Company may transfer all or substantially all of its assets, if in any such case said corporation or other entity shall by operation of law or expressly in writing assume all obligations of the Company hereunder as fully as if it had been originally made a party hereto; the Company may not otherwise assign this Agreement or its rights and obligations hereunder.

Prevailing Law

Your EdenMoney® Account is operated in Isle of Man and these Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Isle of Man. Any dispute under these Terms and Conditions or otherwise in connection with your EdenMoney® Account shall be brought exclusively in the courts of the Isle of Man.

Unenforceability

If any part of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, unlawful or unenforceable then such part shall be severed from the remainder of the Terms and Conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

Definitions

Various terms in these Terms and Conditions have a defined meaning as follows:

“Payment Method” means bank transfer and payment instruments including, but not limited to, credit cards and debit cards.

“Transfer” means monetary value that is being sent from one party to another using the EdenMoney® Account service.

“Upload” means monetary value that is credited using a third party payment method to your EdenMoney® Account

“Customer Services” means our customer service department, with which you may communicate either via the website or by writing to support@edenmoney.com

“Fees” means the charges payable by you to us for using our services

“Business Day” means any day other than a Saturday or a Sunday or a public or bank holiday in the Isle of Man.

“Privacy Policy” is the Company”s policy governing the processing of personal data which is available on the Website, as may be amended from time to time

“EdenMoney® ” means Eden Charge Limited. (Company number: 133351C) whose registered office is at Suite 1, 1st Floor, 4 Athol Street, Douglas, IM1 1LD

“EdenMoney® Account” means the electronic money account you open and maintain through the EdenMoney® Website

“EdenMoney® Website” or “Website” means the website available at www.edenmoney.com

“You”, “your” means you, the natural person or legal entity in whose name the EdenMoney® Account is opened and maintained
